In the state of New Jersey, people selling their homes have the responsibility of disclosing whether or not their homes are habitable. New Jersey state laws stipulate that all sellers are implying that their homes are habitable when they put their homes up for sale. Even if a New Jersey seller advertises their house as being sold "as is," they are still responsible for making sure that the home is habitable when the sales agreement is signed.

New Jersey property sellers are also responsible for revealing any concealed property issues to buyers, even if those problems are not evident at the time the sales agreement is signed. For example, if you know that snow builds up in the gutters surrounding the roof and causes leaking in the house, then you must reveal that information to the buyer, even if the sales contract is being signed in the middle of the summer.
