Real Estate in Pennsylvania

Real estate sellers in the state of Pennsylvania will find that they are required to disclose more information than sellers in other states. Not only do sellers have to disclose the issues that can be seen, but they also are required to disclose any hidden problems that they know about. For example, if the foundation is cracked in a way that is not easy to see visually, the seller is obliged to report that to the potential buyer under Pennsylvania state law. The seller is also required to report on the condition of any appliance or other aspect of the home that is going to be included in the sale. This includes the presence of hazardous materials on the property, and any issues with the title.

While the state of Pennsylvania is big on having sellers report problems that could be physically damaging to the property and prospective buyers, the state is not so adamant about psychological damage. In the state of Pennsylvania, it is not required that a seller reveal any type of traumatic event that took place on a property, even if that event wound up in felony charges or death. Sellers in Pennsylvania are also not required to disclose any issues that cannot be resolved using standard home maintenance. For example, a cracked sewage pipe in the basement is considered a material defect in the state of Pennsylvania, and it does not need to be disclosed to a potential buyer.
