The real estate disclosure form in South Dakota is one that was created by the state government and includes all of the codes both parties would need to file the completed disclosure along with the final sales agreement.

A seller in South Dakota is not required to pay for a professional inspection of the property to complete a disclosure, but the seller is required to be truthful in their completed form. If it is later found that the seller misrepresented their knowledge of the condition of the property to the buyer, then the seller will be liable for all of the costs required to correct the specific problem.
